Arbitration
The Arbitrator is appointed by the Parties of the Dispute and the 'Rules' are governed by the 1996 Arbitration Act. The Appointee is usually chosen for their 'expertise' in the particular dispute such as Sharemilking, Farming or Building. They are impartial and decide on the facts of the dispute and the Award (decision) is legally binding and enforceable in the Court of Law. It is a 'private court' but the Parties can represent themselves or have an Advocate such as me or a legal counsel present their case. The cost of the Arbitrator is shared, but whom may direct a Party to pay the other some or all of the other parties cost. Arbitration is expensive; the parties will have an imposed decision and should be a 'last resort' process to resolve a Dispute.
